Woman comes to the home as a baby? Now she should pay for the care of her mother

Do the biological children have to pay for their parents? even if they gave away after birth? This question is currently the family court in Offenburg. A 55-year-old is vehemently against it. She does not see why she should pay for her mother's care, even though she (now 84) ​​put her as a baby in the home.

The now sick and not audacious elderly woman at that time found herself overwhelmed with the children. Both today's plaintiff and her two sisters ended up in nursing homes. Another son released the 84-year-old for adoption. He is out of it? He has payment obligations only to his adoptive parents.



What is a "serious misconduct"?

The physical three daughters, however, are legally obliged to maintain, if parents are "no longer able to take care of themselves", as the "Badische Zeitung" reported. The child support payments can only be eliminated if the parents have "seriously failed" their children.

As far as the daughters are concerned, it is clear from their perspective that their mother gave them away as babies is clearly a "grave misconduct". The social welfare office, however, insists that the oldest of the three? the only one financially capable? paid the care. Costs of around 13,000 euros have now accumulated.

Court proposes settlement

The Family Court now proposed a settlement. Accordingly, the district social office should waive 70 percent of the claims. Of the total and the further monthly costs incurred, the 55-year-old would have to pay 30 percent.



The parties can consult until April. The plaintiff's lawyer announced that she would "consider" the proposal.

Update, June 19, 2018: After the daughter had rejected the proposal of the court, it came to a verdict by the family court. That decided: The woman does not have to pay for her dependent mother. The District Office, which had filed the claims, now has to decide whether to accept the verdict or appeal to the next instance.
