BGH judgment: ex-partners have to delete nude photos

The Federal Court of Justice has made a groundbreaking verdict: If a relationship diverges, intimate photos created in the common time are deleted. As the ARD reports, the decision goes back to the complaint of a woman who argued with her ex-boyfriend - a photographer - whether he must erase the erotic images or not.

The man had his former partner naked and photographed during sex. Although he had agreed not to share or publish the pictures to others, he did not want to delete them. The ex-partners argued about this before the highest German civil court.

The federal judges put themselves on the side of the woman: Everyone has the right to decide who "insight into their own sex life is granted", they justified their judgment. The woman said yes yes to the recordings, but her consent was limited in the opinion of the judges for the duration of the relationship. Even if the man only occasionally views the pictures, this violates the woman's right to privacy because it is against her will.

Now the photographer has to destroy all pictures. And not only from his computer, but he must also delete the original images on the chip of his camera. The verdict is an important signal, because again and again, nude photos of ex-partners in revenge on the net.
